Terms of Service

These Terms of Service ("Terms") govern your use of the dresspass app and services ("Service"), operated by Wonders AI Inc., 16192 Coastal Hwy, Lewes, DE 19958 ("we", "us"). By creating an account you agree to these Terms.
1. The club
dresspass is a members-only clothing club. Members list clothing, a curator decides what is accepted, and accepted pieces trade for exactly one credit plus a real-money shipping fee paid by the claiming member. We are a venue: sales happen between members, and except where these Terms say otherwise, the members involved in a sale are responsible for it.
2. Eligibility and accounts
- You must be at least 18 years old and reside in the United States.
- One account per person. Creating or controlling multiple accounts, lending your account, or buying/selling accounts is prohibited and grounds for termination of all associated accounts and forfeiture of their credits.
- You are responsible for activity on your account. Keep your credentials secure and your contact and address information accurate.
- We may require identity, phone, or address verification at any time as a condition of continued use.
3. Credits
- Credits are a limited, revocable, non-transferable license feature of the Service. Credits are not money, have no cash value, cannot be purchased, sold, or redeemed for cash, and can be modified or canceled as part of changes to the Service.
- Credits are earned only as provided in-app: a welcome grant (part of which unlocks when your first listing is accepted by the curator) and completed sales. Credits obtained through fraud, self-dealing, or multiple accounts may be reversed.
- Escrow: your credit is debited when you claim a piece and the seller is credited only after delivery is confirmed (Section 6).
4. Listings and curation
- You may list only clothing and clothing accessories that you own outright and may lawfully transfer.
- Every listing is reviewed by a curator. We may accept, decline, or remove any listing at our sole discretion, with or without a stated reason.
- Listing photos and descriptions must accurately depict the actual item that will ship. The photos you submit at listing become the record of the item, and buyers publicly rate each sale's accuracy — those ratings attach to your member profile.
- Counterfeit or replica items are prohibited even if disclosed as such.
- Any member may report a listing in-app; reports go to the curator.
5. Shipping — you are the shipper
- When you claim a piece you pay a shipping fee in real money, processed by our payment provider (Stripe). We use it to provide the seller a prepaid shipping label. Shipping fees are refundable only as described in Section 6.
- The label is valid only for shipping the exact item in the listing it was issued for, in a single package, and for no other purpose.
- The seller is the shipper of record. You are solely responsible for the contents of any package you ship, and you represent with each shipment that it contains only the listed item and nothing unlawful, hazardous, or prohibited by carrier rules (see the Prohibited Items Policy).
- Misusing a label — shipping a different item, an empty package, additional unlisted goods, or anything illegal — is a material breach of these Terms. We may recover label costs from you, cancel your credits, terminate your membership, and report the conduct to carriers and law enforcement.
- Sellers ship within 5 days of a claim. After 5 days the buyer may cancel (Section 6).
6. Delivery, confirmation, and recourse
- Confirming delivery. The buyer confirms in-app when the piece arrives, which releases the seller's credit. If a buyer goes quiet, the seller may confirm delivery no earlier than 10 days after shipping. (Once carrier tracking is integrated, delivery status follows the carrier's scans.)
- No returns — relist instead. Sales are final. If a piece isn't right, you may relist it in one tap: it re-enters the club already curated, and you earn the credit back when another member claims it. One relist per sale; relisting is the club's recourse for "not as hoped."
- Accuracy ratings. After delivery you may rate how accurately the listing described the piece (1–5). Ratings are public, attach to the seller, and one automatic 1-star rating is recorded when an order is cancelled for non-shipment.
- Non-shipment. If the seller has not shipped within 5 days, the buyer may cancel the order in-app: the buyer's credit is returned, the shipping fee is refunded in full to the original payment method, and the piece returns to the seller's listings.
- We may intervene in any sale (cancel, reverse credits, refund shipping) where we see fraud, label misuse, or a violation of these Terms.
7. Prohibited conduct
You may not:
- ship anything other than the exact curated item a label was issued for;
- list or ship anything illegal, counterfeit, stolen, hazardous, or on the Prohibited Items Policy;
- create or use multiple accounts, or transact with an account you control (self-purchases, credit farming between accounts you control);
- manipulate credits, curation, ratings, reports, or cancellation;
- harass other members, scrape the Service, or interfere with its operation.
8. Enforcement
We may investigate suspected violations, and may — with or without notice — decline listings, cancel orders, void labels, withhold or reverse credits connected to suspected fraud, suspend or terminate accounts, and share information with carriers, payment/identity providers, and law enforcement where we believe conduct is unlawful. Where reasonably possible we will tell you what happened and give you a way to respond.
9. Membership and fees
- Membership is free during beta. Founding members (the first cohort, as shown in-app at signup) receive their first year free; an annual membership fee applies afterward at the then-current price shown in-app.
- Shipping fees (Section 5) are charged per sale and are separate from membership.
- Fees are processed by Stripe; we do not store your card number. Except for the non-shipment refund in Section 6 or where required by law, fees are non-refundable.
10. Content license
You retain ownership of the photos and text you submit, and grant us a worldwide, royalty-free license to host, display, and reproduce them to operate and promote the Service. Listing records (including photos) may be retained after a sale for safety, audit, and dispute-handling purposes.
11. Disclaimers and liability
- The Service is provided "as is". We do not guarantee the condition, authenticity, legality, or safety of items listed by members, and item descriptions are the listing member's responsibility, subject to curation as a quality filter — not a warranty.
- To the maximum extent permitted by law, our total liability arising out of the Service is limited to the greater of $100 or the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.
- Carrier performance (loss, delay, damage in transit) is governed by the carrier's terms; we will reasonably assist with carrier claims.
12. Termination
You may delete your account at any time; unspent credits are forfeited (they have no cash value). We may suspend or terminate accounts as described in Section 8. Sections 3, 5, 8, 10, 11, 13, and 14 survive termination.
13. Governing law
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules.
